These Terms of Service govern your use of StitchFreak.com and purchases made from Stitch Freak. By accessing this website, placing an order, or purchasing a product from Stitch Freak, you agree to these Terms of Service and our applicable policies.

Please read these terms carefully before purchasing or using our products.

1. Products & Services

Stitch Freak provides automotive seats, upholstery products, interior components, tools, supplies, custom products, and related merchandise.

Many products offered by Stitch Freak are intended for custom, modified, classic, vintage, hot rod, street rod, restomod, off-road, or other specialty automotive applications.

Unless a product is specifically identified as a direct-fit product for a particular year, make, and model, customers are responsible for determining whether a product is suitable for their vehicle and intended application.

2. Vehicle Fitment

References to vehicle types, makes, models, years, or applications are intended to help customers identify products that may be appropriate for their projects. Such references do not constitute a guarantee of fitment unless the product description specifically states that the product is designed as a direct-fit application.

Universal and custom automotive products may require fabrication, brackets, adapters, drilling, modification, professional installation, or other changes to the vehicle or product.

Customers are responsible for verifying all measurements, dimensions, mounting locations, clearances, compatibility, and installation requirements before purchasing or modifying a product.

3. Product Information

Stitch Freak makes reasonable efforts to provide accurate product descriptions, photographs, specifications, pricing, availability, dimensions, and other information.

However, occasional errors or omissions may occur. Stitch Freak reserves the right to correct errors, inaccuracies, or omissions and to update product information as appropriate.

If a material error affects an order before fulfillment, Stitch Freak may contact the customer to resolve the issue or cancel and refund the affected order.

4. Product Appearance & Materials

Product colors may appear differently depending on lighting, photography, computer monitors, mobile devices, and display settings.

Upholstery materials, stitching, grain patterns, textures, dye lots, foam, leather, vinyl, fabric, and other materials may have reasonable variations.

Such normal variations are not considered defects.

Customers ordering products intended to match an existing interior are responsible for determining whether the material, color, texture, and appearance are acceptable for their application.

5. Custom & Made-to-Order Products

Custom, personalized, upholstered, modified, special-order, and made-to-order products may be produced specifically for an individual customer.

Once production, customization, material ordering, or other work has begun, an order may not be eligible for cancellation, return, exchange, or refund except where required by applicable law or where an approved defect or order-error claim applies.

Production and estimated delivery times are estimates and may vary because of material availability, supplier delays, production schedules, shipping conditions, and other circumstances.

6. Orders

Stitch Freak reserves the right to accept, decline, or cancel an order when reasonably necessary, including in cases involving suspected fraud, payment problems, product availability, incorrect pricing or product information, shipping restrictions, or other legitimate business reasons.

If Stitch Freak cancels an order after payment has been collected and the product has not been supplied, the applicable payment will be refunded.

7. Pricing & Payment

Prices are displayed in the currency indicated on the website and may change without notice.

Customers are responsible for applicable taxes, shipping charges, duties, fees, or other charges disclosed during the ordering process.

Stitch Freak reserves the right to correct genuine pricing or listing errors. If an error materially affects an order that has already been placed, we will contact the customer regarding available options.

8. Shipping & Delivery

Shipping and delivery estimates are provided in good faith but are not guaranteed unless expressly stated otherwise.

Delivery times may be affected by carriers, weather, supply-chain conditions, production schedules, manufacturer delays, address problems, or circumstances outside Stitch Freak's reasonable control.

Customers are responsible for providing accurate shipping and contact information.

Customers should inspect merchandise promptly after delivery and report damaged, defective, or incorrect products in accordance with our Return, Refund & Exchange Policy.

9. Returns, Refunds & Exchanges

Purchases are subject to the Stitch Freak Return, Refund & Exchange Policy published on StitchFreak.com.

Returns require prior authorization when specified by that policy. Merchandise should not be returned without receiving the required Return Goods Authorization (RGA) number and return instructions.

10. Third-Party & Manufacturer Products

Stitch Freak may sell products manufactured or supplied by third parties.

Certain products may be subject to the manufacturer's warranty, return procedures, installation requirements, or other manufacturer policies.

Where applicable, customers may be required to follow the manufacturer's procedures when making a warranty or defect claim.

Stitch Freak does not independently extend a third-party manufacturer's warranty beyond the terms provided by that manufacturer.

11. Installation & Use

Automotive modification and installation can involve inherent risks.

Customers are responsible for ensuring that products are installed correctly and appropriately for their intended application. Professional installation should be used whenever appropriate.

Customers are responsible for inspecting products and verifying suitability before installation, modification, cutting, drilling, sewing, upholstery work, fabrication, or other permanent alteration.

Stitch Freak is not responsible for damage caused by improper installation, improper use, unauthorized modification, failure to follow applicable instructions, or use of a product for an application for which it was not designed, except to the extent responsibility cannot legally be excluded.

12. Seats & Safety-Related Components

Automotive seats, mounting systems, seat belts, restraint systems, brackets, and related components can affect occupant safety.

Customers are responsible for ensuring that seats and related components are mounted securely and installed in accordance with applicable manufacturer instructions, vehicle requirements, and laws.

Unless expressly stated otherwise, the sale of a seat or interior component does not represent that the product is certified for racing, competition, or any particular safety standard.

Professional installation is strongly recommended when an installation affects occupant restraint or vehicle safety systems.

13. Tools & Equipment

Tools and equipment should be used only for their intended purpose and in accordance with applicable manufacturer instructions and safety precautions.

Customers are responsible for obtaining appropriate training and using suitable personal protective equipment when necessary.

14. Intellectual Property

Unless otherwise stated, the Stitch Freak name, branding, logos, original photographs, videos, graphics, written content, product designs, instructional materials, and other original content on StitchFreak.com are owned by or licensed to Stitch Freak and are protected by applicable intellectual-property laws.

Content may not be reproduced, copied, distributed, commercially exploited, or represented as another party's work without authorization, except as permitted by applicable law.

15. Customer-Submitted Content

If customers voluntarily submit photographs, reviews, testimonials, project information, or other content for publication, Stitch Freak may request permission to use that content for website, social-media, promotional, or marketing purposes.

Ownership of customer-created content remains subject to applicable law and any permission granted by the customer.

16. Website Use

Users may not use StitchFreak.com to engage in unlawful activity, interfere with website operation or security, attempt unauthorized access, transmit malicious software, commit fraud, or violate the rights of Stitch Freak or another party.

Stitch Freak may restrict access when reasonably necessary to protect the website, customers, or business.

17. Third-Party Links & Services

StitchFreak.com may contain links to manufacturers, payment processors, shipping carriers, social-media platforms, or other third-party websites and services.

Those third parties operate independently and may have their own terms and privacy practices. Stitch Freak is not responsible for third-party websites or services except to the extent required by applicable law.

18. Warranties

Products are covered by any warranties expressly stated on the applicable product page or provided by the product manufacturer.

Except for warranties that cannot legally be excluded and any express warranty provided with a product, products and services are provided subject to applicable law without additional implied guarantees by Stitch Freak.

Nothing in these Terms is intended to waive or restrict rights that cannot legally be waived or restricted.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Stitch Freak will not be liable for indirect, incidental, special, or consequential losses arising from improper installation, misuse, unauthorized modification, incompatible applications, or other circumstances outside Stitch Freak's reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

20. Indemnification

To the extent permitted by applicable law, users agree to be responsible for claims, losses, or expenses resulting from their unlawful use of StitchFreak.com, misuse of products, or violation of these Terms.

This provision does not apply to losses caused by Stitch Freak to the extent responsibility cannot legally be shifted or excluded.
